If you do get the F-1 visa, then you likely would not face any difficulty at the airport. However, F-1 visa requires non-immigration intent, which would be very difficult, if not impossible, for you to prove. Unfortunately, even J-1 visa requires you to prove non-immigration intent. So if you go outside USA, very likely you will not be able to get back. Therefore, I believe that traveling in your state is not advisable; you should stay put until your children's father is in a position to marry you. Then you can obtain the fiancee visa (K-1) and travel abroad.

Hello All,
Here's my situation below:
I left Company B and applied for H-1 Transfer with Company C (premium) while this case is pending i got a very gud offer from Company D and wanted to me join ASAP. While i was waiting for approval for Company C yesterday i received Query on H-1 Transfer for Company C.
Has anyone been this kind of situation before. I do not want to loose the opportunity from Company D, is there a way Company D can apply for H-1 Transfer with Receipt number(H-1 transfer for Company C).
Please help its very Urgent.

It is their error and mistake. There is no time to correct. So, officer should understand.
becuase, his / her previous approval notices / I-94 copy on approval notice - the lower left part and I-94 the lower right part should have correct start and end dates. he can carry them.
In my son's I-94, the one previous to the lat/latest one, his country of citizenship was notes as Oman (and not India). During the last renwal, it was corrected to India. My attorney placed a note.
I went to Vancouver, BC in March 07 and got H1s stamped.
Any other experiences. Please, take a moment and share.

Yes this can be done as long as the investiment is substantial $50,000 or more and the revenue earned is not marginal (the income derived from the business should not be just enough to support the applicant and his family). The investor possesses means of support independent of the enterprise. What does it take for lawmakers to turn their heads? People holding placcards and signs on streets protesting? Is that the only way to have something heard? Obviously, written articles such as these isn't helping!

As I will not be on H1B and neither I have Green Card ?

My 485 was filed at CSC and later transferred to NSC (WAC receipt). My PD is Jan 2005. Still waiting..
I talked to IO using POJ method yesterday.The IO told me that receipts starting WAC will be processed according to CSC processing time which is at May 2006 for 485 currently! Does anybody know if this is really true or just that one IO not knowing what he was talking about? I know someone has raised this issue on some other thread earlier but till yesterday I did not personally hear this reply. I had called USCIS couple of times before and they all told me USCIS will process my application as per NSC processing time and as per my RD (not ND) till yesterday!

RFE is very clear, basically they are asking the documents, which has Picture ID, where your name was mentioned as Pravin, PRaveenkumar and Pravinkumar.
I dont think u will be able to produce the picture Id for the birth certificate, but for the passport or any other state issued ID, you might be able to have some kind of picture Id dcument which bears your photo.
Please consult a good attorney who can deal with this situation, this is very unusual circumstances where you appeared to have 3 different names in 3 different doucments and the USCIS IO is confused on how to deal with this situation and requesting the evidence just to make sure that he is issuing GC to appropriate person.

Hi...I went to the USA in Dec 05, with a J1 visa, in may 06 after i applyed for changing of status to B2 visa, I got it denied and the letter said I should leave usa. I didnt, staying there until aug 07 (more than 1 year). my visa expired in apil 06 and the letter from uscis i got in may 06. they wrote in my I-94 cos denied 04-18-06. I didnt give back my I-94 when i left the USA. I want to know what are my chances to get a L2 visa (my husband is applying for L1 visa). I also have a second nationallity, can it help me somehow?

I am planning to do concurrent filing on my PERM LC.
1. When will I get my AP/EAD? Will I get it only after I-140 is approved or I-140 approval does not matter?
2. Can I do premium processing on my I-140 in the concurrent filing?
3. Does premium processing available if another I-140 is already pending based on my LC Sub?
Please reply.

Hi,
I had applied for my H1 extension in June 2008 and waited for some time and then upgraded it to premium processing in July. I did not get any result on my H1 extension but in the meantime my GC was approved in August. My question is will i be able to get my H1 processing fee back, at least the premium processing fee. I heard if your H1 processing doesn't get any result in certain time you will be entitled to get your money back.

If you have not received any RFE or NOID or DENIAL or APPROVAL with in 15 calendar day of your PP upgrade then you are entitled to receive the PP fee by USCIS policy. One catch though, not sure whether it will be applicable if your GC was approved with in 15 calendar days of PP upgrade - just throwing one exception. You will never know what is in fine printing :)
