my new company filed h1 transfer on premium on 17 of jan and got fedex delivery on 18th .I have to join this company asap..so I have few question
1. can i join this company even the receipt is not available?
2. how long its take to get the receipt and approval in premium processing?
3. is there any chance to denied if yes what are those factors if any one come accross?

You must have applied 120 days in advance or many days in advance before old AP expiry. USCIS issues AP from the date it was approved so you tend to lose some months. I have heard some other members include a cover letter which says AP start date should be from date of expiry of old AP. Since you already got the document, I doubt you can do much about it. You may lose 2-3 months just trying send it back and requesting it to be corrected. I guess next time when you renew keep the cover letter in mind.
Not necessarly true. Last time when I renewed the AP, it was approved from 2 days prior to intended travel date specified in the application for 1 year. I am not sure what can be done about this 9 months thing.. hopefully other members will pitch in with experience.

I heard TCS is calling back many of their TL/PL/PM back to India. I heard it from 2-3 differrnt sources. Just wanted to see if anybody knows about it.
I personally know a person who is with TCS, he is a team lead or something.... asked to go back by TCS..... they are returning in mid Feb.....

Did anyone (or spouse) applied for Social Security No. who were using ITIN before, for tax purposes. I have applied for 485 and EAD and plan to apply for my wife's Social Security once I get the EAD. Are there any tax filing implications? How to switch to this new number and still be able to e-file next year (assuming I get EAD this year)?

Hello ,
My company file my H1B 3 years back , (from F1-H1), now i have to extend my H1B1 , and my company HR is having a doubt about the fees involeved .
I am sure i have to pay
190 $ - H1 Fees
500 $ - DHS fees
i am not sure if i need to pay 750$ or 1500$ Data collection fees , please suggest .
I 129 application says " if same company filing for , second extension of stay , this fees need not be payed " please advise

yep EAD is linked to your 485 application and not your employer. especially after 180 days of 485 filing a lot people consider themselves free to jump the boat with very little to no issues.

You do not need EAD as your have GC. You can stay and work using your GC. EAD is required while your GC is under process.

My wife is on H4 and willing to apply for H1-B. Her educational qualifications
1.)High school education(12 yrs)
2.)BCA(Bachelor of Computer Applications)- 3 yrs
3.)2.5 yrs of IT experience
4.)She's also doing her M.Sc(Master of Science) in Information Technology. Currently in 2nd year and will be completing by end of 2006. (She may not have the degree certificate by April 2007).
Is she eligible to apply for H1-B for next year 2007

It looks like she is. She has three years BCA and is short of 1 year but you said she has completed one year of MSc so using that one year plus three years BCA, she will be eligible. Make sure she has one full years of MSc trancripts. If she has deffered taking exams or something like this and has not completed the required credits then she might not be. I will suggest you to fax her transcripts to an evaluator and get an evaluation. It should cost $80-100 only but you will be able to sleep at night.

I am working as a biomedical research fellow on a J1 visa for the last 3 years in a non-profit research institute but they cannot sponsor my H1B. I am planning to get a J1 waiver and apply for H1B as I plan to work in the private industry. I am not sure whether I can apply for H1B without an employment offer? I would appreciate any suggestions.
You can never apply for H1-B. Your employer has to petition H1-B on your behalf. So obviously you need to find an employer first with an opening (i.e., you need to find a job first).

I was in united states for 5 years and 2 months on H1-B visa. I did not apply for green card during my stay and had to return to India in Aug'2008 due to personal reasons. I want to find out if I am eligible for applyng H1 in this year's quota through same employer with whom I had earlier H1.
Here is my situation -
1. My H1-B petition is valid till 12th July 2009. My passport is not stamped to reflect this date.
2. I came back to India for good on 31st August 2008.
3. If I go back to US before 12th July, I will only get extension for remaining 10 months (as I was in us for 5 years and 2 months). But I want to go for couple of years, so have to go on new visa after completion of 1 year in India.
So I want to check if I am eligible for filing H1-B in this year's quota through same employer ?

Indian banks usually issue a check/banker's check in name of educational institute.You don't need to pay any tax on it.Then that check is deposit to Univ's/Institute's registrar/bursar office.

My EB2 petition was filed in TSC in June 2009 and on July 20 2009 I received an email saying that " my approval notice was sent".Today the status changed to " Document mailed ON juLY 24 2009 " and also my previous eb1a denial in Feb 2009 got a soft LUD.
I am totally confused by this . Can some one offer their opinion on this strange development ?
Appreciate your help in advance

I am in the same state as your's. After talking with Lawyer and after reading lot of forums, i went ahead and submitted with PAR:PAROLEE for both Manner of Last Entry and Current Immigration status.
I am not lawyer :) but that's waht i went with and submitted just yesterday
