    i think you needed two light sources for this, one coming in from the left to lessen or remove the shadows. Some more DOF? Yes and No depends on what you're after. Flwoers of this colour are so hard to photo IMHO. Reds and flowers always give me grief. I like this rendition of the colour.. Were you happy?

    Yes, I'm happy with the shot in general. I don't like using flash, but didn't have a choice on this one. I was battling heavy clouds and a building wind. I think I'll go back and shoot it again if the blooms are still in decent shape and try a bit more DOF. I also wish I'd noticed that little leaf on the bottom left. I hate when you think you've studied the entire field of view and then miss one little thing.

    Can someone suggest how I can go about getting some clarification from USCIS regarding the usage of H1 post AP (i.e. in Parolee status, can a person use H1 797 approval to work)

    Yes, there's the May 2000 interim memo (which is unfortunately not available from the USCIS website though) and even the memo is not very clear on the subject.

    I was thinking of writing to the Ombudsman and having them get this clarified. We get different opinions from different lawyers. I'd like one straight answer from the authority who's "interpretation" matters : USCIS.

    So, can IV take this forward with the Ombudsman or should I file a 7001 or something with them?

    Thanks for letting me know. I think paskal is in India now. Anyways we had a very small window of time to seek someone quickly. I have found one member willing to reveal his name and give the interview. The information is forwarded to the reporter. The reporter has to quickly do a story so that should be all for now.     I recently did apply for EAD and the documents required are as below

    1. Personal check or Money order for 380$. I prefer sending personal check so that i can know if my check was cashed.
    2. I did paper filing and not e-Filing. Some say efile is better some say paper filing is better , i felt paper filing is easy and better , as we can track our documents sent.
    3. Docs req are
    1. Filled EAD Application form
    2. your 485 receipt notice copy
    3. Current Addresss proof. electricity bill, water bill etc.
    3.Copy of the biographic page of passport for each applicant
    4. i-94 Copy
    5. 2 Photographs
    6. SSN copy ( i put it as my attorney suggested but its not mandatory)
    7. copy of driver licence

    With e-file too, they instantly cash your payment via credit card or debit card. So, you can keep track of it.

    As soon as your wife used EAD, her H4 status was gone.

    For you it would still be safe to continue working on H1.
    Your advantages are:
    1) Having dual status (H1B and AOS) is better than one.
    2) You do not have to worry about EADs for yourself.

    I agree with you. I am not from India and we should concentrat on the problem of the GC problem.

    I-485 Rejected/RND:09-21/I-140 Not Found/USCIS error/Re-file date:10/09/07/Recevied By: 10/09/07/Status:No news after re-sent

    Mine was rejected on 9/19 "Missing or incorrect fee" haven't received the reject notice yet. Since 90 days have passed my attroney has decided to refile a RECONSTRUCTED APPLICATION on Monday (10/15).

    jcrajput: How long did it take for you to receive the rejection notice/package. Did the notice ask you to refile ?

    485 has nothing to do with company. Only I-140 is company dependent. So only reason why 485 will be denied based on company is when the underlying I-140 gets denied i.e. Company revokes 1-140 or USCIS finds something wrong with your company which filed the I-140 before AC21 kicks in. In a separate thread there is action item for USCIS denying I-140 and ignoring AC21 which you may want to participate in if you haven't already. Assuming your I-140 is always valid than Your 485 can be denied only because of you i.e. you were out of status, have a criminal record etc.
